From business shutdowns and PPP loans to vaccinations, COVID has presented unique challenges to Florida businesses. Henderson Franklin’s employment group chair Scott Atwood will address the multi-faceted employment issues that employers may face, including: current obligations over masks and mandatory vaccinations; how to deal with possible long-term disability claims and leave issues arising from COVID; increased union activity; and the pros and cons of a remote/hybrid workforce.

11:30 a.m., General Session, Saving a Buck can Cost you a Million. Update on Recent Employment Cases and Mistakes that Employers Keep Making, presented by Scott Atwood, Esq. and Robert Shearman, Esq.

Labor cost is a big expense, and it’s only natural to want to keep those costs under control. However, cutting corners in employment matters often leads to the same result as cutting corners on equipment or product development. With an eye on recent Supreme Court cases, this session will discuss current trends in employment law including sexual harassment, same-sex discrimination, disability laws, and workplace safety oversight. The discussion will include ways to limit exposure to common lawsuits such as overtime and disability claims, as well as provide advice to limit exposure concerning under-performing employees.

All businesses will inevitably become embroiled in a lawsuit or litigation at some point. In the event your business is involved in a contract dispute, your best chance for a successful outcome may depend on the terms and dispute resolution procedures set forth in your agreements and contracts. In this break-out session, Henderson Franklin attorneys will examine ways to address potential issues contractually before they arise, contractual dispute resolution provisions, options for alternate dispute resolution, and offer practical guidance should your business become a party to a lawsuit.

11:30 AM Breakout Session #1B: What Businesses Should Know to Make Informed Real Estate Decisions, moderator: Colby Keefe, Esq.; panelists: Amanda Barritt, Esq., Amanda Ross, Esq., and Jeff Wright, Esq.

Shifting real estate trends have caused many businesses to reevaluate their office space and consider purchasing, selling, or renting new space to meet their needs. If your business is expanding, reducing, or simply relocating its operations, our real estate and land use attorneys have a handful of core considerations that business owners should keep in mind before and during the purchase, sale or lease of a commercial space. More specifically, attendees will learn the importance of finding an ideal space for your business’s intended use that will accommodate your operations and customers; what provisions should be flagged in a contract for sale and purchase or a lease agreement before signing; and, understanding the business’ rights and obligations during its use of the commercial space, including ways to reduce the risk of premises liability lawsuits.

Tritt (President and Co-founder of Insurance Management Consultancy Group)

Timely investigation of reported work accidents limits the liability of the employer and carrier. Florida Chapter 440 may protect employers from claims such as unemployment, EEOC, wrongful termination and retaliation claims. In this panel discussion, attendees will learn not all injuries reported to have occurred at work are compensable under Chapter 440; offering return to work postdate of injury limits ongoing liability; and, failure to return injured employee back to work after a work accident may create additional employment liability.

1:45 PM Breakout Session #2A: Start-Up Bootcamp, presented by Matthew Brust, Esq. and Luca Hickman, Esq.

Every successful business starts with a great idea. Startup Bootcamp will arm entrepreneurs with the basic legal knowledge to start and run a business, including: what organizational and tax structures are appropriate for a new business; the importance of intellectual property for start-ups; and, the best ways to protect your company’s brand.

1:45 PM Breakout Sessions #2B: Important Issues Often Overlooked Running a Family Business, presented by Anthony Cetrangelo, Esq. and Eric Gurgold, Esq.

Many times estate planning documents are not harmonious with corporate agreements. It is important to understand what happens if your will or trust conflicts with your business plan. The presenters will share which legal document would prevail and how to prevent future issues with them before they occur.

An additional fundamental part of estate planning is to ensure your family business is set up correctly to have maximum protection from creditors. Attendees will learn ways to ensure they are able to pass down as many assets as possible to future generations.

3:00 PM General Session: YOU are in the Pilot’s Seat: Adapt, Execute & Overcome, presented by guest speaker Elizabeth McCormick (sponsored by Copylady)

Former U.S. Army Black Hawk Pilot Elizabeth McCormick will share professional and personal development secrets for success she learned through overcoming overwhelming obstacles as a helicopter pilot while inspiring attendees to Adapt, Execute & Overcome. In this session, attendees will learn the key to elevated confidence and effectiveness, both in and outside of the workplace. Elizabeth will also share resilience techniques and leadership strategies so attendees may advance toward their higher goals by helping others take the lead.

COVID Precautions

The venue will be setting up tables to allow extra distance between attendees (therefore, seating is limited). All Marriott staff wear masks and encourage non-vaccinated attendees to wear a mask. Weather permitting, the cocktail reception at the end of the day will be outside by the water.
