Overview

Joseph “JD” Bootka is an associate in Henderson Franklin’s Tort and Insurance Litigation Department. He defends businesses, property owners, insurers and other clients in personal injury and general liability matters, with a particular interest in premises liability cases. His experience also includes automobile negligence, first- and third-party insurance claims, construction defect disputes and matters involving insured risks.

JD represents clients throughout the litigation process, from the initial evaluation of a claim through discovery, motion practice, mediation, settlement negotiations and trial preparation. He approaches each matter by identifying the core legal and factual issues early, developing a practical strategy and keeping the client’s objectives in focus. Clients rely on him for clear guidance and efficient resolutions while protecting their interests at every stage.

Before joining Henderson Franklin, JD practiced civil litigation with a Fort Myers law firm, where he represented private clients and the State of Florida’s Division of Risk Management. His work for the State included negligence, employment discrimination, civil rights and qualified and sovereign immunity matters. In one significant case, JD helped secure summary judgment for the Florida Department of Children and Families by establishing that the agency owed the plaintiff no legal duty. He later drafted the agency’s answer brief, and the appellate court affirmed the judgment.

A Detroit native, JD earned his bachelor’s degree in political science with a minor in legal studies from Aquinas College. He moved to Southwest Florida to attend Ave Maria School of Law, where he earned his Juris Doctor in 2021. JD is admitted to practice in Florida, before the U.S. District Courts for the Middle and Southern Districts of Florida and before the Supreme Court of the United States.

Outside the office, JD enjoys spending time with his wife at the beach or pool and walking local trails. He also enjoys smoking food for cookouts with family and friends and cheering for the Detroit Red Wings and Detroit Lions.

JD has been a member of The Florida Bar since 2021 and the Calusa Inns of Court since 2023.
