Overview

Richard Mancini is a Florida Supreme Court Certified Circuit Court Mediator who focuses his practice on trust and estate litigation, contested guardianships, business disputes, banking and financial matters, and mediation and arbitration. He is frequently appointed by the court to serve as a fiduciary in contested probate and trust matters and regularly mediates and arbitrates disputes. Richard represents fiduciaries and beneficiaries in complex trust and estate disputes, breach of fiduciary duty claims, and contested probate proceedings. He also handles contract and real property litigation, including foreclosure matters.

Richard serves as chair of the firm’s Expansion Committee and co-chair of the Estate and Trust Planning Department. He is admitted in all Florida State Courts, as well as the United States District Court for the Middle and Southern Districts of Florida.

Throughout this career, Naples Illustrated has recognized Richard as a “Top Lawyer” in alternate dispute resolution (2018) and in trusts and estate law (2021-2025). He has also been recognized nationally by Best Lawyers in America® for trusts and estate law and litigation (2025-2026).

Professional And Civic Affiliations

Richard is an active member of the Real Property Probate and Trust Law sections of the Florida Bar, Lee County Bar and Collier County Bar Associations. He is also a member and former chairman of SWFL, Inc. Rich previously served as President and Board Member of Naples Christian Academy, and was Chairman of the Board of the Bonita Springs/Estero Economic Development Council (BSEEDC), now known as the South Lee EDC.

Representative Matters

  • Serve as a mediator and arbitrator in complex probate and trust disputes involving competing beneficiary claims, contested fiduciary appointments, and allegations of breach of fiduciary duty.
  • Represent personal representative and trustee defending claims of undue influence and incapacity by other beneficiaries.
  • Serve as co-counsel representing beneficiary that challenged inter-vivos transactions based on undue influence and coercion, obtaining jury verdict to return substantial property to trust.
  • Represent adult children of incapacitated mother in obtaining full guardianship to protect mother from unscrupulous friends and family.
  • Serve as co-counsel representing personal representative of estate who claimed real property was not asset of decedent, obtaining summary judgment in favor of estate.
