Luis E. Rivera has broad experience in business litigation, bankruptcy, creditors’ rights and insolvency counseling. He is Board Certified in Business Bankruptcy Law by the American Board of Certification. Since 2010, Luis has also served as a U.S. Bankruptcy Trustee for the Middle District of Florida (Fort Myers Division). As a panel trustee, Luis is one of three court-appointed fiduciaries who administer Chapter 7 bankruptcy cases filed in Southwest Florida.
Luis’ bankruptcy experience includes representation of lenders, landlords, individuals and financial institutions in both consumer (Chapter 7 & 13) and Chapter 11 reorganization cases, as well as involuntary and discharge proceedings. As a trustee, he is also routinely involved in the liquidation of business enterprises, including the recovery and sale of assets; the investigation, development, and prosecution of litigation to recover funds for creditors; and the reconciliation and payment of claims held by creditors.
In addition to bankruptcy and creditors’ rights matter, Luis has extensive experience in a variety of business and general civil litigation matters, including contract disputes, real property litigation, mortgage foreclosure, landlord/tenant disputes, and title insurance litigation.
Luis holds an AV® Preeminent™ rating from Martindale-Hubbell. For eight consecutive years (2009-2016), he has been recognized by Florida Super Lawyers® magazine for his work in business litigation. In 2015, Luis was honored by the Southwest Florida Bankruptcy Bar as the recipient of the Alexander L. Paskay Professionalism Award.
Luis attended law school at Washington and Lee University and served as Editor-in-Chief of the Washington and Lee Journal of Civil Rights and Social Justice. He currently resides in North Fort Myers with his wife and three sons.
Luis is admitted to practice in all state courts in Florida: the United States Court of Appeals, Eleventh Circuit; the United States District Court, Middle District of Florida; the United States District Court, Southern District of Florida; the United States Bankruptcy Court, Middle District of Florida; and the United States Bankruptcy Court, Southern District of Florida.
Luis is active in the local legal community, serving as President of the Southwest Florida Bankruptcy Professionals Association. He also serves on the District-Wide Steering and Local Rules Committees of the United States Bankruptcy Court for the Middle District of Florida. Luis is also a member of the Lee County Bar Association’s Law Week committee and Chairman of the Law Week Blood Drive.
Luis currently serves on the board of directors of two non-profit entities intended to promote bankruptcy legal education and to fund pro bono and other public service projects relating to the practice of bankruptcy – the Middle District of Florida Pro Se Bankruptcy Legal Assistance Clinic, Inc. and the Bankruptcy Law Educational Series Foundation, Inc. (“BLES”). He is an alumnus of the Chamber of Southwest Florida’s 2010 Leadership Lee Class. Luis previously served as Chairman of the Advisory Board for the Hispanic Institute at Hodges University, Chairman of the Lee County Hispanic Affairs Advisory Board, and is a former member of the Lee County Charter Review Committee.
